La legislaci\u00f3n actual protege este derecho y limita las condiciones que los propietarios pueden imponer.<strong>\u00a0Aunque algunos due\u00f1os de vivienda intentan restringir la tenencia de animales, la ley respalda a los arrendatarios y establece sanciones si se vulneran sus derechos.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">La<a href=\"https:\/\/x.com\/cconstitucional?s=11\">\u00a0Corte Constitucional<\/a>\u00a0dej\u00f3 claro<strong>, desde la sentencia T-035 de 1997, que tener una mascota hace parte del derecho al libre desarrollo de la personalidad y a la intimidad.<\/strong>\u00a0Estas libertades no son absolutas, pero deben respetarse en condiciones razonables. La normativa proh\u00edbe establecer reglas generales que impidan tener mascotas en edificios o conjuntos residenciales.\u00a0<\/strong>Lo importante es garantizar la sana convivencia y cumplir con los reglamentos internos de cada copropiedad.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-reglas-claras-para-la-convivencia-con-animales\">Reglas claras para la convivencia con animales<\/h2>\n\n\n\n<p class=\"has-medium-font-size\">Aunque no se puede prohibir tener mascotas,&nbsp;<strong>los arrendatarios s\u00ed deben respetar ciertas condiciones.<\/strong>&nbsp;La ley exige que los due\u00f1os de animales<strong>&nbsp;recojan los excrementos, utilicen correa en zonas comunes y eviten ruidos<\/strong>&nbsp;o comportamientos que incomoden a los vecinos<strong>. Estas normas buscan equilibrar derechos individuales con la tranquilidad de la comunidad.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tampoco est\u00e1 permitido que los propietarios impongan cobros adicionales por tener mascotas.\u00a0<strong>Si un arrendador exige un pago extra o incrementa el valor del arriendo por ese motivo, incurre en una pr\u00e1ctica ilegal<\/strong>. El arrendatario puede presentar una queja formal, ya que no existe base jur\u00eddica para esos cobros.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"492\" src=\"https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=1024%2C492&#038;ssl=1\" alt=\"\" class=\"wp-image-1742\" srcset=\"https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=1024%2C492&amp;ssl=1 1024w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=300%2C144&amp;ssl=1 300w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=768%2C369&amp;ssl=1 768w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=1536%2C738&amp;ssl=1 1536w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=750%2C361&amp;ssl=1 750w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?resize=1140%2C548&amp;ssl=1 1140w, https:\/\/i0.wp.com\/xclusiva.com.co\/wp-content\/uploads\/2025\/05\/image-82.png?w=1560&amp;ssl=1 1560w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-contratos-terminacion-anticipada-e-indemnizaciones\">Contratos, terminaci\u00f3n anticipada e indemnizaciones<\/h2>\n\n\n\n<p class=\"has-medium-font-size\">La Ley 820 de 2003&nbsp;<strong>regula los contratos de arrendamiento y establece que no se puede terminar el contrato solo porque el inquilino tenga una mascota.&nbsp;<\/strong>Esta medida solo ser\u00eda v\u00e1lida si el animal infringe normas de convivencia expresamente acordadas en el contrato o el reglamento del edificio.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Adem\u00e1s, si el propietario desea terminar el contrato antes de tiempo sin una causa legal v\u00e1lida, debe notificarlo con al menos tres meses de anticipaci\u00f3n y pagar una indemnizaci\u00f3n equivalente a tres meses de arriendo.
